House To Take Legal Action Against Trump's National Emergency Declaration

On Thursday, Speaker of the House Nancy Pelosi announced that the House of Representatives will take legal action against President Trump over his national emergency declaration. "The President's sham emergency declaration and unlawful transfers of funds have undermined our democracy, contravening the vote of the bipartisan Congress, the will of the American people and the letter of the Constitution," Pelosi stated. "Congress ... must reassert its exclusive responsibilities reserved by the text of the Constitution and protect our system of checks and balances."

House Democrats claim that Trump’s national emergency declaration violates the appropriations clause in the United States Constitution. The clause in the Constitution that House Democrats are referring to states that “No Money shall be drawn from the Treasury, but in Consequence of Appropriations made by Law; and a regular Statement and Account of the Receipts and Expenditures of all public Money shall be published from time to time.”
